Utopic, Inc. ("Utopic," "we," "us," or "our"), a Delaware corporation, develops games and collectibles for kawaii culture. This Privacy Policy explains what personal information we collect, why we collect it, who we disclose it to, and the choices you have.
It applies to utopic.co and its subdomains, to the sign-up and waitlist forms we run on Facebook and Instagram, to our email communications, and to any Utopic product or service that links to this Policy (together, the "Services").

IP address, browser type and version, operating system, device type, referring URL, pages viewed, and the dates and times of your visits. We collect this through standard server logs kept by our hosting provider.
utopic.co does not currently run advertising or analytics trackers. If that changes, we will update this Policy and tell you before the change takes effect.
When you submit a Meta instant form, Meta transmits to us the information you entered or that was pre-filled from your Meta profile — for our forms, your email address, your name where you provided it, and your answer to our age question. We also receive aggregated, non-identifying reports from Meta about how our advertisements performed.
We do not collect government identification numbers, precise geolocation, biometric information, health information, financial account numbers, payment card numbers, racial or ethnic origin, religious beliefs, sexual orientation, or the contents of your private communications on other services. We do not ask for any of these on our forms, and Meta's Advertising Standards prohibit us from requesting most of them without Meta's prior written permission.

We do not keep personal information for longer than is reasonably necessary for the purpose it was collected, plus any period required by law.
Purpose limitation. We use information you gave us for a stated purpose only for that purpose or one compatible with it. If we ever want to use it for something materially different, we will ask you first.

Each service provider is bound by contract to use the information only to provide services to us.
We do not sell your personal information for money. We do not rent, trade, or otherwise transfer your email address to unrelated companies for their own marketing purposes.
One nuance, stated plainly. Under California and several other state privacy laws, using an advertising platform in the way described in Section 5 can count as "sharing" personal information for cross-context behavioral advertising, and under some statutes' broad definitions, as a "sale." We disclose it here so that you know exactly what happens. Section 7 tells you how to stop it.
We advertise on Facebook and Instagram. We use Meta's advertising tools in the following ways.
How to control this. To stop your information being used for advertising:
Every marketing email we send includes a working unsubscribe link and our physical mailing address, as the CAN-SPAM Act requires. Unsubscribing takes effect immediately in most cases, and in no event more than ten business days. Once you unsubscribe, we add your address to a permanent suppression list so that we do not email you again.
We extend the following to everyone in the United States, whether or not the law where you live requires it.
How to make a request. Email legal@utopic.co from the address you signed up with and tell us what you want. If you write from a different address, we may ask you to verify your identity — we will not ask you for sensitive information in order to do so. You may use an authorized agent, and we will ask for written proof of their authority.
How long we take. We acknowledge requests within ten business days and respond within forty-five calendar days. If we need more time, we will tell you why and take up to forty-five additional days.
If we say no. We will tell you why, and you may appeal by replying to our response with the word "Appeal." We will decide the appeal within forty-five days and, if we still decline, tell you how to contact your state attorney general.
No retaliation. We will never deny you a product or service, charge you a different price, or give you a lower quality experience because you exercised any of these rights.
Global Privacy Control. We honor the Global Privacy Control signal as a valid opt-out of the sale and sharing of personal information. See https://globalprivacycontrol.org/.
California residents. California law gives residents rights to know the categories and specific pieces of personal information collected, the sources, the business purposes, and the categories of third parties it was disclosed to; to delete; to correct; to opt out of sale and sharing; and to limit the use of sensitive personal information. The categories we collect and disclose are set out in Sections 2 and 4. We do not collect sensitive personal information as that term is defined under California law. California's "Shine the Light" law (Cal. Civ. Code § 1798.83) additionally allows residents to request a list of third parties to whom we disclosed personal information for those third parties' own direct marketing purposes in the previous calendar year. We make no such disclosures, and you may write to legal@utopic.co to confirm.
Utopic's Services are intended for people eighteen years of age and older. Our games and collectibles are designed for an adult audience that enjoys kawaii aesthetics.
We do not direct our Services to children under thirteen, and we do not knowingly collect personal information from anyone under thirteen. We ask you to confirm that you are eighteen or older before you join our waitlist, and we set our advertising to be delivered only to adults.
If you are a parent or guardian and believe your child has given us personal information, email legal@utopic.co. We will delete it promptly and remove the address from all of our lists.
We protect personal information with measures appropriate to its sensitivity, including encryption in transit, access controls limiting who at Utopic can see subscriber data, and reliance on established service providers that maintain their own security programs. We do not collect or store payment card numbers.
No method of transmission or storage is completely secure, and we do not promise that our safeguards are impenetrable. If a breach affecting your personal information occurs, we will notify you and the relevant authorities as required by applicable state breach-notification law.
Our Services link to sites we do not control, including Steam, itch.io, Discord, YouTube, and Instagram. This Policy does not apply to them. Please read their privacy policies.
Utopic, Inc. is based in the United States and processes personal information here. If you are in the European Economic Area or the United Kingdom, additional rights may apply to you, and you should contact us at legal@utopic.co.
We may update this Policy. The version in effect is always the one posted at https://www.utopic.co/privacy, with the "Last updated" date at the top. If we make a material change — for example, if we begin selling products, or begin using advertising or analytics trackers on utopic.co — we will publish the updated Policy before the change takes effect, and tell you by email or by a prominent notice on utopic.co. We review this Policy at least annually.
